1. Introduction

The general conditions of sale detailed below (hereinafter referred to as the "General Conditions") govern the contractual relationship between any user of the ZEN-AND-SOUNDS-ACADEMY.COM website (hereinafter referred to as a "User" or " You") whose head office is located at 88, Boulevard de Charonne 75020 PARIS SIRET number: 834 332 793 00027. 

These general conditions of sale are the only ones applicable and replace all other conditions. Zen & Sounds may occasionally be required to modify certain provisions of its general conditions, so it is necessary that these be reread before each visit to the ZEN-AND-SOUNDS-ACADEMY.COM site (hereinafter referred to as the "Site") . These modifications are enforceable from the time they are posted online and cannot be applied to contracts entered into previously. Each purchase on the Site is governed by the general conditions applicable on the date of the order. We consider that by validating your order, you unreservedly accept our general conditions of sale after having read them.

By accessing the Site, you agree to comply with the General Conditions as well as the Conditions of Use appearing therein.

2. Registration deposits and balances

Places in Zen & Sounds trainings can be reserved by paying a deposit for each individual reservation. All deposits are non-refundable and non-transferable, except where cancellation is decided by the organizers.*
 

Payment of the balance is due a maximum of 30 days before the first day of training. We will not send a reminder email. If we do not receive your payment of the outstanding balance, your place may be reserved by another participant.

3. Cancellation conditions

  • Deposits: All deposits are non-refundable and non-transferable, except in the case where the cancellation is decided by the organizers.*

 

  • Full Payments - For seats paid in full and then cancelled, the following applies:

More than 4 weeks before the start of the training: 100% refund less the deposit.

2 to 4 weeks before the start of the training: 50% refund  minus the down payment.

From 2 weeks before the start of the training: no refund will be made.

 

* In the event of cancellation of the training by the organizers, all deposits and payments made by the participants will be fully refunded to them. This reimbursement does not take into account plane tickets and/or any other transport reserved by the participants. IT IS THEREFORE STRONGLY ADVISED TO PROVIDE CANCELLATION INSURANCE FOR YOUR TRANSPORT TICKETS.

 

IT IS RECOMMENDED THAT YOU TAKE OUT TRAVEL INSURANCE IN CASE YOU HAVE TO CANCEL due to unforeseen circumstances.

 

If the training organizer decides to offer a discount to certain participants, or last minute reduced rates, this does not affect the status of participants who have already paid the full price and no discount will be due.
 

Zen and Sounds accepts no responsibility for loss, damage, injury or illness, which may occur during training, or while traveling to or from Zen and Sounds training. He is  strongly recommended that participants have their own travel insurance covering any loss or damage, including repatriation if necessary.
 

Zen and Sounds takes every measure to ensure that participants in physical activities are not pushed beyond the limit of their abilities. In the event of any particular pre-existing injury or any illness, we ask that you indicate this to the trainer, and we ask that you also indicate to him that you find the training too difficult if this is your feeling. We advise that in case of pain or illness during training, you stop and rest.

1. Introduction

3. Product information

Zen & Sounds takes the greatest care in posting information relating to the essential characteristics of the products online, in particular by means of descriptions from its partners and suppliers and photographs illustrating the products. However, it is not mandatory that a product sheet contains all the technical characteristics.  

4. Price

The sale prices indicated on the Site are in euros and include all taxes but excluding delivery costs. Any delivery costs are indicated to the User as they choose products and are invoiced to them at the end of the order in addition to the price of the selected products.

The prices appear in euros.
We reserve the right to modify our prices at any time (particularly due to currency fluctuations).

5. Availability

We will honor your order within the limits of our available stocks.

If one of the products ordered is not available in our stocks, we undertake to contact you by e-mail within 7 days from the date of your order in order to inform you of this and to tell you within what timeframe, this product could be delivered to you. For products not stocked with us, our offers are valid subject to availability from our suppliers. These indications on the availability of the products are provided to you when you place your order. This information coming directly from our suppliers, errors or exceptional modifications are beyond our control and cannot engage our responsibility.

The times indicated are average times and correspond to processing times and delivery. In case of deliverable items on different dates given their availability, the delivery time is based on the average time. To improve the service,  ZEN-AND-SOUNDS.COM  however, reserves the right to split deliveries, this will be with your agreement (by telephone or email). Participation in processing and shipping costs will only be charged for a single shipment.  ZEN-AND-SOUNDS.COM  cannot be held responsible for the consequences due to a delay in delivery. Any order not shipped within 30 days of the order may be canceled by the User by simply sending an e-mail).

The availabilities displayed are given for information only and in no way represent a contractual commitment.

 

6. Method of delivery

Your order will be delivered to you at the address you gave us when you placed your order.

We offer the following delivery method:

  

   * Standard Shipping
This choice of delivery allows you to receive your package within 3 to 5 working days thanks to the Post Office and the Colissimo service.

Note: During the coronavirus crisis, delivery times may be slightly longer, as La Poste does not pass every day. Thank you for your understanding. 

We do our best to meet the delivery times mentioned on the Site. However, we cannot be held responsible for the consequences due to a delay in delivery or loss of parcels caused by a third party or by you or due to an unforeseeable and insurmountable cause constituting a case of force majeure.

 

In the event of non-receipt of a parcel within the time indicated, you have a period of 15 days to file a complaint with your nearest post office with your tracking number. An investigation will be opened, with file number. During this period, no refund or return can be made. (This has the exception of bulky items shipped by a carrier other than LA POSTE)

Compulsory procedure upon receipt:
In the presence of the carrier, you must:

- Imperatively check the package, both the exterior and the content in order to notify reservations if the product ordered is missing, incomplete or damaged

- If the package is damaged: put a reserve because without reserve, the insurance does not work

- If there is breakage: put a reserve, take pictures and report it to us during the day

- If the delivery person does not let you open it to see the good condition of the contents, you must note on the delivery note: "The delivery person refused that I check the contents"

If you do not do this upon receipt of your package, the refund or replacement guarantee will not work. You will then have to see with your own insurance.

 

Without prejudice to the applicable legal warranties, we recommend that you address any reservations as to the lack of conformity of the products existing on the date of delivery as soon as possible by post to Zen & Sounds 88 Boulevard de Charonne 75020 PARIS or e-mail to  contact@zenandsounds.com .

  If the products need to be returned to us, please send them to Zen & Sounds 88 Boulevard de Charonne 75020 PARIS. The return of products can only be accepted for products in their original state, namely in particular with their packaging, accessories, and instructions for use. Shipping costs are the responsibility of the User.

  In the event of proven non-compliance, the User will have the choice between repairing or replacing the product unless the desired option entails a manifestly disproportionate cost compared to the other modality.

  Finally, in the event of payment by check, we will only send the order upon receipt of the check on our account.

In case of delivery failure:

The costs related to the failure of the delivery due to the Customer (return of the undelivered parcel) will be borne by the latter.
 

In the event of non-receipt of a package indicated as 'delivered' by post:
The mention "delivered" by post indicates that the seller has fulfilled his delivery contract. The seller is not held responsible if a package mentioned 'delivered' by post is not received by the buyer. The buyer must contact the post office and launch an investigation with these services. However, the post office trusts its staff and it is often difficult to obtain reimbursement.

 

7. Approval

When you click on the "Validate" button after the order process, you declare that you accept the order and all of these General Terms and Conditions of Sale fully and without reservation. The data recorded on  ZEN-AND-SOUNDS.COM  constitutes proof of all transactions made by  ZEN-AND-SOUNDS.COM  and its customers.

 

8. Payment

We currently use several means of payment: By credit card for online payments. By cheque, bank transfer or credit card (for telephone orders).

For payment by check, simply send us, along with your order summary, your check payable to Zen & Sounds. Upon receipt of your check, we will inform you of receipt by email and we will ship your order as soon as the check is cashed in our account.

 

9. Right of withdrawal and returns

In the event of a withdrawal or non-compliance, prior contact with  ZEN-AND-SOUNDS.COM  must necessarily have been established, no item will be accepted if it is not in its original packaging and will not be treated without it being accompanied by a return agreement provided by  ZEN-AND-SOUNDS.COM .

For the products  available and in stock, we allow you to benefit from the 14 clear days provided for by article L 121-20 of the Consumer Code) to return a product that does not satisfy you. You can within this period return this product, at your expense, accompanied by your invoice and a return authorization agreement that you will have obtained on request by email to:  contact@zenandsounds.com  and specifying the method chosen (reimbursement or credit note).

Upon receipt of the agreement by email from Zen & Sounds, you have 14 days to return the product to us. This right of withdrawal is exercised without penalty. Return shipping costs are your responsibility.

Used products:

The withdrawal period only concerns new products and not second-hand products, second-hand products are not subject to return or warranty.

Special orders:

For products that are the subject of a special order following your request (rare products made or delivered to order) by email or telephone, we do not make returns.

Breakage and deterioration of a product:

The right of withdrawal does not apply upon receipt of a damaged, broken or cracked package. Returns for reasons of deterioration (cracks, breakage, etc.) are only accepted upon sending a photo by email to  contact@zenandsounds.com  within 48 hours after receipt. After this time, no refund or exchange will be accepted.

The "breakage guarantee" is limited to the replacement of defective parts, repair, exchange or refund if the product becomes unusable. The instruments must arrive at Zen & Sounds carefully packaged, postage paid, and will be returned postage paid (the cost of sending and returning the replaced product is the responsibility of the customer). We then undertake to pay for any repairs from suppliers. Whatever the problem with your item, it is imperative to enclose with the defective products a copy of the invoice and an annotated return form: "seen with ... name of contact at Zen & Sounds).

The "breakage guarantee" does not apply to products with a very specific procedure upon receipt (this special procedure is specified by the seller to the buyer). If the buyer does not respect the special procedure announced by the seller by email (such as checking the product in front of the delivery person, postman or in the relay or post office) there will be no possible refund.

The "breakage guarantee" does not cover wear or tonal qualities. The warranty is automatically void in the event of misuse, authorized technical modification or repair carried out by a workshop not approved by Zen & Sounds.  

 

The warranty does not cover the repair of damage resulting from:   

* a cause external to the instruments (for example, accident, shock, breakage or crack due to transport, etc.),   

* a fault of the customer resulting for example from use or non-use that does not comply with the manufacturer's specifications, 

* of a use harmful to the good conservation of the product,   

* commercial or collective use, the use of unsuitable utensils, cleaning products, accessories or consumables.   

* from an intervention by a repairer not approved by Zen & Sounds 

* defects and their consequences linked to any external cause.

If the repair is not covered, the manufacturer will draw up an estimate.

Administrative costs will be requested by the manufacturer in the event of refusal to pay this estimate. If the estimate is approved, a check, payable to Zen & Sounds and corresponding to the amount of the estimate, will be sent to us.
The guarantees mentioned in this paragraph are not transferable in the event of the sale of the instrument to a third party.

Refund method:
During a reimbursement, the user is reimbursed by bank transfer or by check or paypal if the payment has been made by the latter.


Returning the package:

Only products will be accepted in new and complete condition (accessories, manuals, etc.), returned in their original packaging and sent to:

We advise you to return the goods to us by registered mail or by colissimo followed and possibly to take out insurance with the carrier for the market value of the products. This is necessary in the event of theft or loss of this merchandise by their services. In all cases the return is made at the expense and risk of the consumer.

We decline all responsibility in the event that the item to be exchanged does not reach us. No investigation with the Postal Services, nor Reimbursement or Exchange can then be carried out. Any product that has been damaged, or whose original packaging has been damaged in conditions exceeding its simple opening, will not be refunded, or partially refunded under the conditions indicated below.

If the item is returned incomplete or damaged to Zen & Sounds, a discount on its price will be applied according to the diagnosis made by us. We will justify to the customer the application of this discount by communicating to him a document drawn up by our care.

Cancellation of the order :

In the event of cancellation of the order by the Customer, Zen & Sounds will, within 30 days of the cancellation, refund the price of the order minus the shipping costs paid by the seller and processing generated by the order (5%). In the event of a return of an order that has benefited from the free postage offer, the recipient will be reimbursed for the returned items less the actual postage paid by the seller when sending the package.

 

10. Dispute and Liability

This contract is subject to French law.

The products offered comply with the French legislation in force and the standards applicable in France. The photographs, texts, graphics, information and characteristics reproduced and illustrating the products presented are not contractual. Consequently, Zen & Sounds cannot be held liable in the event of an error or omission in any of these photographs, texts or graphics, information or characteristics of the products or in the event of modification of the characteristics of the products by the suppliers. . 

Zen & Sounds cannot be held responsible for non-performance of the contract concluded in the event of out of stock or unavailability of the product, force majeure, disruption or total or partial strike, in particular of postal services and means of transport and/or communications. , flood, fire. Zen & Sounds will not incur any liability for any consequential damages as a result of these presents, operating loss, loss of profit, loss of opportunity, damages or costs, which may arise from the purchase of the products. We remind you that it is prudent to back up the data contained in the products purchased. Zen & Sounds cannot be held responsible for any loss of data, files or damage defined in the previous paragraph. The total or partial impossibility of using the products, in particular due to incompatibility of equipment, cannot give rise to any compensation or reimbursement or questioning of the responsibility of Zen & Sounds. Zenandsounds.com disclaims all liability in the event that the content of these sites contravenes the legal and regulatory provisions in force.

Zen & Sounds cannot be held liable in the event of non-compliance with the legislation of the country where the products are delivered. It is up to you to check with the local authorities the possibilities of importing or using the products or services that you plan to order.

This agreement is subject to French law. The language of this contract is French. In the event of a dispute, the courts of Paris (France) will be competent.

 

11: In case of breakage during transport

IMPORTANT: In addition to the guarantees described in these General Conditions of Sale, Zen & Sounds does not provide any other guarantee.

 

12: Processing of parcels: unclaimed / unclaimed / refused

If your package is returned by our service provider for the following reason:

   * NPAI (Does Not Live at the Address Indicated)
  * Package unclaimed during its litigation period
  * Package refused by the recipient upon delivery

It will be sent back to you against a new payment of postage.

 

13: Lost or damaged package

For any reason whatsoever, if the package sent by Zen & Sounds does not arrive at its destination, despite a colissimo number indicating the contrary, then the customer will be invited to contact the post office closest to his home ( accompanied by the colissimo number). Zen & Sounds cannot be held responsible for a parcel allegedly delivered by La Poste to its customer, which the latter declares not to have received. In this case, Zen & Sounds reserves the possibility of compensating its customer, in the form of vouchers equivalent to the value of the package. No voucher can be refunded in cash.

Also, if the customer noticed that his package, whether at the time of delivery of the package to his home or its withdrawal from a post office, presented anomalies (deterioration of the package, opening of the package, etc.), he can :
- refuse it by marking the reason "refusal" on the form to be signed by the post office. The customer must then complete the procedure provided for this purpose in a post office and send it by registered mail with acknowledgment of receipt within 3 clear days of delivery of the package to the Post Office and to Zen & Sounds customer service.
- accept it by indicating his reservations on the delivery slip from the Post Office which he signs against obtaining his package. Then, he must within 3 clear days maximum send an explanatory letter to Zen & Sounds accompanied by a copy of the signed and stamped postal delivery slip.

In the event that the customer claims not to have received one or more products, and Zen & Sounds finds an anomaly between the weight of the package taken over by post and that of the products claimed on arrival, Zen & Sounds will not is not required to reimburse its client.

Any package accepted by the customer will be considered as a delivered package (delivery date of the post office in Colissimo delivery). Failure to comply with the procedures set out below, no claim from the buyer will be accepted.

Lost package:
In the event of a lost package, the customer has the option of asking Zen & Sounds to initiate a postal investigation. If the latter reveals that La Poste is held responsible for the loss of the parcel, Zen & Sounds will reimburse its customer up to the amount of the reimbursement made by La Poste if the parcel has been insured.

 

14. Intellectual Property

All texts, comments, works, illustrations and images reproduced on the "ZEN-AND-SOUNDS-ACADEMY.COM" site are reserved under copyright as well as intellectual property and for the whole world. As such and in accordance with the provisions of the Intellectual Property Code, only use for private use is authorized subject to different or even more restrictive provisions of the intellectual property code. Any other use constitutes counterfeiting and is sanctioned under Intellectual Property unless prior authorization from Zen & Sounds.

 

15. Protection of personal data

The information that you communicate to us being essential for the treatment and the routing of the orders, the establishment of the invoices and the contracts of guarantee, their absence involves the cancellation of your order. By registering on the Site, you undertake to provide us with sincere and true information about yourself. The communication of false information is contrary to these general conditions as well as to the conditions of use appearing on the Site.

If you accepted it during your identification on the Site, promotional emails (e-mails) offering you news, advice, etc. will be sent to you. You can ask to no longer receive e-mails from us at any time by clicking on the link provided for this purpose and inserted at the bottom of the page of each of the e-mails that we will send you.

Zenandsounds.com undertakes not to disclose to third parties the information that you communicate to us. These are confidential. They will only be used by its internal services for the processing of your order and only to reinforce and personalize the communication between you and us, in particular by the newsletters of Zenandsounds.com to which you will have subscribed.
